This Privacy Policy explains how Modioza, operated by Chipi, collects, uses, discloses and protects personal information when you visit modioza.com, place an order, contact us or otherwise interact with the store.

2. Information we collect

Depending on how you use the store, we may collect:

  • Order information: products viewed or purchased, cart activity, order value, cancellations, returns, refunds, exchanges, delivery information and tracking details;
  • Payment information: payment status, payment method and transaction identifiers. Payment providers process full payment credentials, and we generally do not receive complete card details;
  • Account and communication information: customer account details, messages, support requests, reviews, feedback and communication preferences;
  • Device and usage information: IP address, browser type, device type, cookie or similar identifiers, pages viewed, referring source, approximate location and interactions with the store; and
  • Fraud and security information: information and signals used to authenticate transactions, prevent abuse and protect the store, our service providers and our customers.

6. Shopify

Our store is hosted by Shopify. Shopify processes personal information when you visit the store, use the checkout, create an account or make a purchase. This may include information needed to provide the storefront, checkout, payment, account, security, fraud-prevention and other commerce services.

Shopify and its service providers may process information in countries outside your province, territory or country of residence.

7. Service providers and disclosures

We disclose personal information only when reasonably necessary for the purposes described in this Privacy Policy. Recipients may include:

  • Shopify, which provides the storefront, checkout, customer-account and related commerce services;
  • payment and fraud-prevention providers used to authorize, process and secure payments;
  • 17TRACK, which supports shipment tracking and delivery-status information;
  • Messaging, which supports customer communications and customer-service interactions;
  • postal operators, carriers and logistics providers involved in shipping and delivering orders;
  • suppliers and fulfilment partners where reasonably necessary to prepare, fulfil or deliver an order;
  • hosting, information-technology, security and business-service providers that help us operate and protect the store;
  • professional advisers, accountants, auditors, insurers, courts, regulators and authorities where reasonably necessary or legally required; and
  • a purchaser, investor or successor in connection with a legitimate sale, merger, financing or restructuring, subject to appropriate confidentiality and data-protection safeguards.

We do not provide personal information to another party merely so that party can use it for its own unrelated direct marketing without the consent or other lawful authorization required by applicable law.

8. Order tracking

We use 17TRACK to provide shipment-tracking and delivery-status services. Information such as an order number, tracking number, carrier, shipping destination and delivery status may be processed for these purposes.

Tracking information may also be processed directly by the postal operator, carrier or logistics provider responsible for delivering the order.

9. Customer communications

We use Messaging to communicate with customers and respond to questions, support requests and order-related issues. Messages you send may include your name, contact information, order details and any other information you choose to provide.

Please do not send complete payment-card details, passwords or other unnecessary sensitive information through customer-support messages.

10. Marketing communications

We send commercial email or SMS only where you have provided consent or where another lawful basis permits us to do so. Marketing messages identify the sender and contain an available method to unsubscribe.

You can withdraw marketing consent at any time by using the unsubscribe link in an email, replying STOP where supported or contacting info@modioza.com.

Messages necessary to process or service an order, payment, delivery, return or customer account are not marketing messages and may still be sent after you unsubscribe from marketing.

11. Cookies and similar technologies

We use cookies and similar technologies for essential store functions, security, fraud prevention, customer preferences, website performance and store analytics.

When information is no longer required, we delete, anonymize or securely dispose of it, subject to lawful backup, archival and record-retention requirements.

14. International processing

Chipi is established in the Netherlands and sells products to customers in Canada. We and our service providers may process or store personal information in the Netherlands, other countries within the European Economic Area, Canada, the United States and other jurisdictions where our service providers operate.

Information processed outside your province, territory or country may be subject to the laws and lawful access procedures of that jurisdiction.

Where required, we use contractual, technical and organizational safeguards designed to protect personal information when it is transferred internationally.

15. Security

We use reasonable administrative, technical and physical safeguards appropriate to the nature and sensitivity of the information. These measures are intended to protect information against loss, misuse, unauthorized access, disclosure, alteration and destruction.

No internet transmission, website or electronic storage system is completely secure. We therefore cannot guarantee absolute security.

Depending on your location and applicable law, you may have the right to:

  • ask how your information has been used or disclosed;

We will respond within the period required by applicable law. Access requests governed by Canadian federal privacy law are generally answered within 30 calendar days. Where European data-protection law applies, requests are generally answered within one month, subject to legally permitted extensions.

If you are located in Canada and are not satisfied with our response, you may contact the privacy regulator responsible for your province or territory or the Office of the Privacy Commissioner of Canada.

If European data-protection law applies, you may also submit a complaint to the Dutch Data Protection Authority or another competent supervisory authority in the country where you live, work or believe an infringement occurred.

18. Children

The store is intended for adults who can legally enter into a purchase contract. We do not knowingly request or collect personal information from children for their independent use of the store.

If you believe a child has provided personal information to us without appropriate authorization, contact us so we can investigate and take appropriate action.
